Service Provisions and Terms

Warning for the USER AND MEMBER COMPANY: Please read carefully the below Provisions and Terms and ALLFORHOTELS Privacy Policy (composing the “Agreement” altogether) concerning the utility of the central ALLFORHOTELS web site (now included in www.ALLFORHOTELS.com) (“ALLFORHOTELS Web Site”) and ALLFORHOTELS Services (“USER AND MEMBER COMPANY”) provided in this way.
All areas of ALLFORHOTELS web site are free to enter and you are assumed to accept the relevant parts of this Agreement by entering these areas.
1. ALLFORHOTELS Services
This Agreement covers the services provided by ALLFORHOTELS (referred to as “ALLFORHOTELS Services”):
ALLFORHOTELS Online Informing Service (“ALLFORHOTELS Informing Service”) is a job informing service managed centrally by ALLFORHOTELS and covers the provision of job data and information (“ALLFORHOTELS Data”) collected and arranged together with other information and data using a method developed by ALLFORHOTELS. ALLFORHOTELS Informing Service is included in the “Index” of ALLFORHOTELS Web Site. ALLFORHOTELS Informing Service contains the information concerning the products and/or services of MEMBER COMPANIES and therefore, access of the USERS shall be provided to the photos and information of products and/or services of MEMBER COMPANIES which are in the supplier position.
1.2 ALLFORHOTELS reserves the right to change, modify or suspend the ALLFORHOTELS Services (or any part of these) from time to time. This Agreement represents the whole of the agreement between the parties concerning the ALLFORHOTELS Services. ALLFORHOTELS may make changes to this Agreement published over ALLFORHOTELS Web Site by notifying beforehand.
2. Utility of ALLFORHOTELS Services
2.1 MEMBER COMPANY is qualified to contractual membership after the conclusion of the membership contract based on the principles specified by ALLFORHOTELS and payment of the annual service charge. In this case, the MEMBER COMPANY is liable to hand its title, name, surname, telephone and fax number of the authorized person, the preferred language and the information related to the field of activity of the MEMBER COMPANY correctly. MEMBER COMPANY warrants the correctness and currency of the information handed at the application. ALLFORHOTELS can not be charged because that these information are not correct or current.
2.2 USER is the visitor who visits free of charge the web site where ALLFORHOTELS Services are given and uses the ALLFORHOTELS Services and Data. The USER accepts not to copy the ALLFORHOTELS data or Contents of MEMBER COMPANIES obtained by way of ALLFORHOTELS Services in any way except job purposes or connected to those (except accidental imaging), and market, resell, distribute, retransmit, publish, carry by automatic scanning or downloading or any other way or use commercially in any way.
2.3 The ALLFORHOTELS data or contents of MEMBER COMPANIES can not be used as a portion of any product or service and presented to MEMBER COMPANIES in such a way of competing with ALLFORHOTELS, with no restriction and for dispelling doubts.
2.4 The utility of ALLFORHOTELS Data or ALLFORHOTELS Services is by no means allowed as “spam” and/or with purposes of undesirable illegal marketing - for example (and with no restriction) the USER should not use the ALLFORHOTELS Data or ALLFORHOTELS Services to send undesirable messages for the purpose of marketing or product sales or servicing. ALLFORHOTELS Services can not be used for sending e-mails other than the institutional e-mail addresses of the person listed in the ALLFORHOTELS Web Site.
3. License
ALLFORHOTELS gives a license (“License”) of entering and using personal, standard, nontransferable ALLFORHOTELS Services and ALLFORHOTELS Data to the USER for internal purposes only under the provisions and terms of this Agreement. The USER can nor transfers his/her rights given by this Agreement, leave and submit as sublicense and the USER especially does not allow any person to enter and use the ALLFORHOTELS Data without the prior written permission of ALLFORHOTELS (excluding the authorized employees in case the USER is an institutional company or business partnership).
4. Property and Industrial Property Rights
4.1 Excluding the scope predicted by the law, ALLFORHOTELS agrees not to perform back-engineering, back-compilation, dismounting, modification or change concerning all or some parts of the software accessed via its Services or connected to those.
4.2 The USER agrees that ALLFORHOTELS Data are a valuable information source and the copyrights, trademarks and all other industrial property rights of and concerned with ALLFORHOTELS Services and ALLFORHOTELS data or, as the case may be, the licensors in cases of existence of MEMBER COMPANIES. The USER can not change, use, distribute and deduct any intellectual and industrial property right symbol concerning the source or property of ALLFORHOTELS Data or any other definition or information.
4.3 ALLFORHOTELS and the logo for ALLFORHOTELS are registered trademark and can not be utilized or duplicated due to any reason.
4.4 The USER and MEMBER COMPANY can not change, adapt or revise any portion of ALLFORHOTELS services and can not use software to harm the ALLFORHOTELS Services in whatsoever manner.
5. LIABILITY
5.1 The USER acknowledges that he/she has to use his/her own skills and judgment while using the ALLFORHOTELS Services and he/she uses the ALLFORHOTELS Services bearing the risks. Any utilization that the USER has obtained from ALLFORHOTELS Services or benefited from the information acquired in this way is under the liability of the USER.
5.2 Without any limitation, the USER compensates ALLFORHOTELS against any damage, loss or liability, including any lawsuit by the MEMBER COMPANY or any claim or any regulatory penalties, arising from the direct or indirect utilization of ALLFORHOTELS Data or ALLFORHOTELS Services by the USER concerning the information provided as a part of the ALLFORHOTELS Services. By utilizing the Services given by ALLFORHOTELS, The USER declares and acknowledges that ALLFORHOTELS is not liable for the defects in the goods and/or services procured through liaison with MEMBER COMPANIES and declares and acknowledges to release ALLFORHOTELS right now against any liability attributed to ALLFORHOTELS in probable lawsuits related to this matter.
5.4 The USER acknowledges that ALLFORHOTELS can not characterize the relevant suppliers or the suppliers concerning the USER. The USER shall use his/her own skills and judgment to evaluate the results of ALLFORHOTELS Services and he/she may not charge ALLFORHOTELS against any internal or external expenditures arising as the result of acting upon all the other information obtained from ALLFORHOTELS Services (including any external consultancy and internal management expenses, without any limitation). Besides, the USER may not charge ALLFORHOTELS due to any potential loss arising from lost job opportunities or the relevant suppliers not characterized through ALLFORHOTELS Services.
5.5 The USER also agrees that ALLFORHOTELS only facilitates the job between the USER and MEMBER COMPANIES thanks to the database composed by itself, and it is not under consideration that ALLFORHOTELS does not participate in any contractual transaction between the USER and any MEMBER COMPANY. Accordingly, any article and terms between the USER and any MEMBER COMPANY concerning any supply or conflict is only under the liability of the USER.
5.6 ALLFORHOTELS Data are collected using the polls, evidence lists and thorough negotiations listed in the ALLFORHOTELS Data. Much of the ALLFORHOTELS Data are provided to ALLFORHOTELS by third parties. Although ALLFORHOTELS commits to make all reasonable efforts to ensure that the information of ALLFORHOTELS be correct in commercial sense as far as possible, ALLFORHOTELS declines any liability due to any currency, usability or any fault of ALLFORHOTELS Data.
5.7 ALLFORHOTELS Services and Data are presented to utilization “as is” without any guarantee, provision or term including the guarantees, provisions or terms concerning their satisfactory quality, commercial suitability, fitness for purpose, or meeting any definition or their general quality (without any limitation).
5.8 In accordance with the interactive services and in general, the structure of Internet, ALLFORHOTELS gives no warranties or promises related to ALLFORHOTELS Services utilization can not be exempt from failures or faults, and ALLFORHOTELS shall not have any responsibility or liability concerning any notification or network failure, delay or failure or arising from these (temporarily or otherwise). ALLFORHOTELS may change the application concerning the presentation of the Services of subject provisions and terms listed here without showing any causes or interrupt or completely stop the service.
5.10 Ticking some links in this site may direct the USER to other sites, and ALLFORHOTELS is not responsible and liable for the correctness and content of any information or any subject in such sites, in any wise.
6. Fees and Security
6.1 In case the MEMBER COMPANIES desire to enter particular parts (“Paid Services”) of the ALLFORHOTELS Services, they should pay non-returnable fee(s) for entrance/subscription to ALLFORHOTELS ANNUALLY in the form and rates determined by ALLFORHOTELS (or in the way as directed by ALLFORHOTELS).
6.2 The visit of USERS to the site is not subject to any fee against the ALLFORHOTELS Services.
6.3 In ALLFORHOTELS, there are blocking risks concerning the delivery of information over Internet as in the other communication systems. Although ALLFORHOTELS has all normal measures to minimize the blocking risks, the USER acknowledges that any information is sent under the risk of the USER and ALLFORHOTELS shall not be responsible for security in the transmission process of these information.
7. Privacy Policy
When you are registered to us as MEMBER COMPANY or applied for information, we shall take the personal information concerning you given by yourself. If you wish to visit this site only for a glance as a USER, your name and contact information is not requested. MEMBER COMPANIES may always update and change their firm information through the “Members Area” of this site.
8. Equipment
The USER shall be individually responsible for acquiring, operating and maintaining all necessary computer hardware and software, modems and telecommunication connections to enter ALLFORHOTELS Services.
9. Privacy
The method developed by ALLFORHOTELS concerning to collect and arrange all information within ALLFORHOTELS Services and associated with those, and ALLFORHOTELS Data shall be kept private.
10. Termination
ALLFORHOTELS may terminate ALLFORHOTELS Services (or any one of those) any time and without any cause by notification to the MEMBER COMPANY 30 (thirty) days before. When the MEMBER COMPANY does not fulfill its liabilities under the Agreement or the MEMBER COMPANY is in bankruptcy, liquidation or composition, has optional agreements with its creditors or in loan default or appoints a trustee, ALLFORHOTELS may suspend the ALLFORHOTELS Services (or any one of these) any time without resorting to any rights or remedies, and terminate this Agreement in a sudden application decision. In case of suspension of ALLFORHOTELS Service or the termination of this Agreement, ALLFORHOTELS shall, in no terms, be liable to return any fee or part of it (if exists). Upon the termination of this Agreement, the MEMBER COMPANY shall immediately dispose all ALLFORHOTELS Data copies it had acquired for the purpose of using in ALLFORHOTELS Service, and although it was permitted to maintain the utilization of the information acquired to use by ALLFORHOTELS Service before the termination, it shall immediately stop benefiting from ALLFORHOTELS Services.
11. Relevant Laws and Conflicts
This Agreement shall be governed and interpreted in accordance with Turkish laws (excluding the laws related to disputes of laws) and the parties shall refer to Turkish jurisdiction. Antalya Courts and Execution Offices are competent in the settlement of possible conflicts between the parties. This Agreement shall not hinder any legitimate prosecution similar to or concerning contract violation, intellectual and industrial property rights and other general legal principle violations in any other jurisdiction authority throughout the world.
